Connected-product data and the EU Data Act

The Data Act (Regulation (EU) 2023/2854) deals with, among other matters, access to data from qualifying connected products and related services. Not every vintage object or website account falls within those product-data provisions. Classification depends on the product, its data-generating functions, how data is available and the respective seller, user and data-holder roles.

The current Retronative preview hosts listings, journal content, accounts and unpaid enquiries. It does not itself offer a connected-device telemetry service or a cloud-hosting service to visitors. That does not exempt a qualifying connected-product sale from applicable duties. Before such a contract, the responsible seller must supply the relevant product-specific information required by Article 3(2), including what data is generated, its format and estimated volume, continuous/realtime generation where relevant, storage and retention, and access/retrieval/erasure arrangements. Manufacturer documentation may assist, but a generic privacy notice is not a substitute.

If you wish to ask about product data, contact info@retronative.com with the listing/product reference and the nature of your request. We will identify our role, provide information we hold, and explain any relevant manufacturer, related-service provider or other data holder. We cannot promise access to data that does not exist, that we do not hold, or to another person’s protected personal data. No extra right to disclose personal information is created merely by referring to the Data Act.
